RETURN POLICY AND RIGHT OF WITHDRAWAL

This Return Policy applies to products sold online by:

This policy applies in accordance with Romanian and European consumer protection legislation, including Government Emergency Ordinance (GEO) No. 34/2014 on consumer rights in contracts concluded with traders.

1. Right of withdrawal within 14 days

For orders placed online, the consumer has the right to withdraw from the contract, without giving any reason, within 14 calendar days from the date on which they take physical possession of the product.

For an order containing multiple products delivered separately, the period runs from the date on which the consumer takes physical possession of the last product.

To exercise the right of withdrawal, the consumer must inform NOUMENO SRL of their decision by means of an unequivocal statement sent to:

The consumer may use the withdrawal form provided by NOUMENO SRL, but its use is not mandatory.

2. Sealed products

Noùmeno products are delivered in their original packaging and, where applicable, are fitted with sealing elements intended to protect the integrity and hygiene conditions of the product.

For products that benefit from the right of withdrawal, the consumer may exercise this right within the legal 14-day period, in compliance with the conditions set out by applicable legislation.

3. Unsealed products

In accordance with Article 16(e) of GEO No. 34/2014, the right of withdrawal does not apply in the case of:

"the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the consumer."

For Noùmeno products to which this legal exception applies, unsealing the product after delivery results in the loss of the right of withdrawal.

In this context, removing, tearing or damaging the sealing element applied to the product or its packaging is considered unsealing, where that element serves to demonstrate that the product has not been opened or used after delivery.

NOUMENO SRL will not automatically refuse every return request. The exception to the right of withdrawal will be applied only when the legal conditions provided by the legislation in force are met.

4. Inspecting the product

The consumer has the right to examine the product to the extent necessary to establish its nature, characteristics and functioning, within the limits provided by applicable legislation.

Where the right of withdrawal applies, the consumer may be liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product, under the conditions provided by law.

5. Exercising the withdrawal

Where the right of withdrawal applies, the consumer shall send the request to:

The request should preferably include:

• the buyer's first and last name;
• the order number;
• the products for which withdrawal is requested;
• the order date;
• the date the product was received;
• the preferred method of contact.

The absence of any of this information does not cancel the legal right of withdrawal where it can be reasonably identified.

6. Returning the product

After sending the withdrawal notice, the consumer shall return the product without undue delay and, in any event, no later than 14 days from the date of communicating the withdrawal decision, in cases where the right of withdrawal applies.

We recommend using a shipping service that allows parcel tracking and keeping proof of shipment.

7. Return shipping costs

The direct costs of returning products are borne by the consumer, except where the law provides otherwise or NOUMENO SRL expressly agrees to bear these costs.

If the product received is defective, damaged, non-conforming or different from the one ordered, the situation will be resolved in accordance with the consumer's rights regarding product conformity, and this provision does not limit the consumer's legal rights.

8. Refunds

In the event of a valid exercise of the right of withdrawal, NOUMENO SRL will refund the amounts paid by the consumer for the products to which withdrawal applies, including, where applicable, the standard delivery cost.

The refund will be made using the same payment method used for the initial transaction, unless the consumer expressly agrees to a different method.

NOUMENO SRL may withhold the refund until it has received the returned product or until it has received proof that the product has been sent back, whichever occurs first.

If the consumer has expressly chosen a delivery method more expensive than the cheapest standard delivery method offered by NOUMENO SRL, the cost difference will not be refunded, to the extent permitted by applicable legislation.

9. Damaged, defective or non-conforming products

This right of withdrawal policy does not limit the consumer's rights regarding non-conforming products, product defects, products damaged upon delivery or incorrectly delivered products.

In the event of a product conformity issue, the consumer must contact:

and provide, if possible, the order number and a description of the issue.

NOUMENO SRL will resolve the situation in accordance with applicable legislation on the conformity of goods and consumer rights.

10. Incorrect products received

If the consumer receives a product different from the one ordered, they must contact NOUMENO SRL at:

In this case, the product will be replaced or the situation will be resolved through the applicable corrective measure in accordance with the law.

11. Products damaged during transport

If the parcel shows visible damage upon receipt, we recommend that the consumer photograph the outer packaging and the product and contact NOUMENO SRL as soon as possible.

This is intended to facilitate the resolution of the complaint and does not limit the consumer's legal rights.

12. Cases in which the right of withdrawal does not apply

The right of withdrawal does not apply in the situations expressly provided by the legislation in force.

For products sold by NOUMENO SRL, depending on the nature of the product and the specific conditions of the sale, the exception provided by Article 16(e) of GEO No. 34/2014 for sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the consumer may be relevant.

This exception does not apply automatically to all products and will be assessed based on the specific product and situation.

13. Consumer's legal rights

No provision of this Return Policy is intended to limit, exclude or waive consumer rights that cannot be limited or excluded by agreement between the parties.

If any provision of this policy conflicts with an applicable mandatory legal provision, that legal provision shall prevail.
